Exclusion of liability

1. Content of the Web site

HSP Hochspannungsgeräte GmbH does not warrant the timeliness, correctness, completeness, or quality of the information provided. Liability claims against HSP Hochspannungsgeräte GmbH that are based on material or non-pecuniary damage of any kind caused by the use or failure to use the offered information or as a result of using erroneous and incomplete information, are excluded as a matter of principle to the extent that HSP Hochspannungsgeräte did not act deliberately or with gross negligence. All offers remain subject to change and nonbinding. HSP Hochspannungsgeräte GmbH expressly reserves the right to amend, supplement, or delete portions of pages or the entire Web site without separate notice or to cease publication, either temporarily or permanently.

2. Reference & links

Any direct or indirect references to outside Web sites (hyperlinks) that are outside the scope of responsibility of HSP Hochspannungsgeräte GmbH would result in a liability obligation only if HSP Hochspannungsgeräte GmbH were aware of the content and only if it would be technically feasible for it to prevent the use of unlawful content and it could reasonably be expected to do so. HSP Hochspannungsgeräte GmbH hereby expressly declares that no illegal content was recognizable on the pages to be linked at the time the links were established. HSP Hochspannungsgeräte GmbH has no influence whatsoever on the current or future configuration, content, or authorship of the linked/connected pages. Therefore, it hereby expressly distances itself from all content of all linked/connected pages that were changed after establishment of the link. This statement applies to all links and references established within the company’s own Web site and for all outside entries in the guest books, discussion forums, link directories, and mailing lists created by HSP Hochspannungsgeräte GmbH, as well as any other form of data base whose content is accessible to outside entries. The provider of the Web page to which reference has been made, not the party to which the respective publication merely refers through links, is solely responsible for illegal, erroneous, or incomplete content and, in particular, for damage resulting from the use or failure to use such offered information.

3. Copyrights and trademark rights

HSP Hochspannungsgeräte GmbH does its utmost to respect the copyrights of the graphics, audio files, video sequences, and texts used in all of its publications and to use graphics, audio files, video sequences, and texts that it has produced or to use unlicensed graphics, audio files, video sequences, and texts. All brand names and trademarks that are mentioned in the Web site and may be protected by third party copyrights and trademarks are subject without limitation to the respective applicable trademark rights and the ownership rights of the individual registered owners. It may not be concluded on the basis of a mere mention that the trademark is not protected by third-party rights. The copyright for objects that have been produced by HSP Hochspannungsgeräte GmbH itself remains solely with HSP Hochspannungsgeräte GmbH. Any duplication or use of such graphics, audio files, video sequences, and texts in other electronic or printed publications is not allowed without the specific authorization of HSP Hochspannungsgeräte GmbH.

4. Data protection

If it is possible within the Web site to input personal or business data (e mail addresses, names, addresses), the user divulges that data on an specifically voluntary basis. The use of and payment for all offered services is also allowed – to the extent this is technically feasible and can be reasonably expected – without providing such data or when providing anonymized data or a pseudonym. The use by third parties of the contact data disclosed as part of the section on company information or comparable information, such as postal addresses, telephone numbers, and fax numbers, as well as e mail addresses, for the transmission of information that has not been specifically requested is not allowed. The right to institute legal proceedings against parties sending what is known as “spam” is specifically reserved in the event of violations of this prohibition.

5. Legal effect of this exclusion of liability

This exclusion of liability should be considered an integral part of the Web site from which reference has been made to this page. To the extent that portions or individual formulations in this text do not correspond, no longer correspond, or do not completely correspond to the current legal situation, the content and validity of the remaining parts of the document shall remain unaffected.
